WIDE WORLD WEB SITE - TERMS OF USE

PLEASE READ THESE TERMS OF USE. You must agree to these Terms of Use to register and participate. By clicking the "I agree" button below, you are agreeing that you will comply with and be legally bound by these Terms of Use, and you are agreeing that we will have the right to terminate your access to this Web Site if you violate these Terms of Use. If any of these Terms of Use are unacceptable to you, do not click "I agree." Contact WIDE World Customer Service at wideworld@gse.harvard.edu with questions.

This WIDE World Web Site is maintained by WIDE World of the Harvard Graduate School of Education ("GSE"), a part of Harvard University ("Harvard"). As used in these Terms of Use, the terms "we," "us" and "our" refer to WIDE World, GSE and Harvard. The terms "WIDE World Course" and "Course" refer to any and all courses offered by WIDE World in which you register or to which you have access through this Web Site.

  1. Payment Due Date. If you are individually registering in any WIDE World Course through this Web Site, payment for the Course is due within two weeks of the date you complete registration. Payment can be made using a credit card, check or money order, or by providing WIDE World with a purchase order number. (This does not apply to anyone who has been registered by a university, a government agency or another program sponsor.)

  2. Course Withdrawals and Refund Policy. If you have individually registered in any WIDE World Course through this Web Site, and you withdraw at least 14 days prior to the Course start date, you will have the option of obtaining a full refund, obtaining a credit that you can use toward a future Course, or enrolling an alternative participant in your place. Course credit is only good for six months from the date of issue of the credit. Withdrawals less than 14 days prior to the Course start date will not be entitled to any refund or credit. (This does not apply to anyone who has been registered by a university, a government agency or another program sponsor. In such a case, you should contact the sponsor representative or liaison to report your withdrawal from the Course.) If you are completely inactive for two consecutive sessions of the WIDE World Course in which you are enrolled (i.e. no contribution to the discussion forum, no e-mail communication to coach or instructor), your access to the course will be revoked permanently, and you will not receive a refund of any fees paid.

  3. Course Cancellation. If you have individually registered in and personally paid for any WIDE World Course through this Web Site, and we, at our discretion, cancel the Course, you will receive a full refund within 60 days of cancellation. (This does not apply to anyone who has been registered by a university, a government agency or another program sponsor.)

  4. No Harvard Credit. WIDE World Courses are offered for professional development credit, but do not offer or result in any Harvard academic credit. You may take our Course syllabus to your local college or university to request academic credits, if applicable.

  5. Password. You may not permit anyone else to use your WIDE World Course account or password.

  6. Web Site Rules. You agree to comply with our Web Site rules and instructions that we post elsewhere in this Web Site.

  7. Materials You Provide. You may be required to post (or e-mail) your comments, class assignments and other original work on this Web Site in connection with a WIDE World Course. You agree that we may freely use, copy, distribute, and display on this Web Site any Course-related materials or work that you provide to us through e-mail or this Web Site.

  8. No Auditors. WIDE World Courses will not admit auditors.

  9. Becoming Inactive in a Course. If you are completely inactive for two consecutive sessions of any WIDE World Course in which you are participating (for example, no contribution to the discussion forum, no e-mail communication to coach or instructor), at our discretion we may terminate your access to the Course, and there will be no refund of the Course fees.

  10. Our Proprietary Rights. The text, images, and other content of this Web Site (the "Content") and all Course Materials are the property of Harvard and are protected by copyright, trademark and other intellectual property laws.

  11. Permitted Activity. You may access and use the Content and the Course materials for personal education and professional development in accordance with these Terms of Use. Subject to these Terms of Use, you may view, download and print the Content and Course materials solely for your personal, noncommercial use.

  12. Prohibited Activity. You may not copy, modify, post, translate, transmit, display, sell, distribute or otherwise make available any of the Content or Course materials, without our express written consent. You agree not to use any of the Content or Course materials in connection with any form of solicitation or marketing. You agree not to use any name or emblem of Harvard, GSE or WIDE World in any advertising or promotional materials, or in any manner that would inaccurately suggest any relationship between you and us or infringe any of our rights.

  13. Disclaimer of Warranties. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DO NOT GIVE ANY WARRANTIES OF ANY KIND (EXPRESS, IMPLIED OR OTHERWISE) REGARDING ANY WIDE WORLD COURSE OR COURSE MATERIALS, THIS WEB SITE OR THE CONTENT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN THROUGH ANY WIDE WORLD COURSE OR COURSE MATERIALS, THIS WEBSITE OR THE CONTENT, AND WE DO NOT WARRANT THAT THIS WEBSITE WILL OPERATE WITHOUT ERROR OR INTERRUPTION.

  14. Limitations of Liability and Remedies. IN NO EVENT SHALL OUR LIABILITY ARISING OUT OF ANY KIND OF LEGAL CLAIM (WHETHER IN CONTRACT, TORT, INCLUDING NEGLIGENCE, OR OTHERWISE) IN ANY WAY CONNECTED WITH THESE TERMS OF USE OR YOUR PARTICIPATION IN ANY COURSE EXCEED THE AMOUNT (IF ANY) YOU PERSONALLY PAID US FOR ANY COURSES. WITHOUT LIMITING THE FOREGOING,WE ARE NOT RESPONSIBLE FOR ANY MESSAGES OR STATEMENTS POSTED IN THIS WEB SITE BY ANY COURSE PARTICIPANT.

  15. Links to Other Sites. This Web Site may contain links to web sites maintained by others. These links are provided solely as a convenience to you and not as an endorsement by us of the contents of any such third-party web sites. We are not responsible for the content of linked third-party sites and do not make any representations regarding the contents or accuracy of materials on such sites. If you decide to access linked third-party web sites, you do so at your own risk.

  16. Applicable Law and Jurisdiction. These Terms of Use shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts USA, without regard to its conflicts of law rules. You agree not to bring a suit or action concerning these Terms of Use in any court other than a state or federal court sitting in Suffolk or Middlesex County, Massachusetts. You hereby agree to submit yourself to the jurisdiction and venue of such courts and waive any jurisdictional or venue defenses otherwise available.

  17. General. If any provision of these Terms of Use is held to be invalid or unenforceable, that provision, to the extent unenforceable, will be struck, and will not affect the validity or enforceability of the remaining provisions. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. These Terms of Use, together with our enrollment/registration form and our fee schedule, set forth the entire agreement between you and us with respect to the subject matter of these Terms of Use.
